ELIGIBILITY: To enter you must be a resident of the United
States or Canada and between the ages of 11 and 18. Eligible
schools must be middle schools, junior highs, intermediate
schools or high schools located in the United States or Canada.
Employees of Sponsor organizations and other supporting companies
and organizations that participate as Sponsors, are not eligible
to enter. All rules apply in the MindOH!
Privacy Policy and the MindOH!
Terms of Use. All Federal, state and local rules and regulations
apply.
3. DRAWING AND JUDGING: One (1) school will be selected
as the grand prize winner depending on the number of eligible
survey entries* received on behalf of that school. One (1)
school will be selected as the runner-up depending on the
number of survey entries received on behalf of that school.
In the event of a tie, the grand prize winner and the runner-up
will be chosen in a drawing between all tied schools. Any
schools that have been selected as winners of past Character's
Cool Contests are not eligible for the grand prize. *"Eligible
survey entries" is defined as a completed Zoomerang survey
including all required contact and demographic information.
One (1) individual participant will be chosen in a random
drawing from all eligible survey entries* received and deemed
as the winner of the individual competition. Additional drawings
may be conducted for any additional prizes donated to the
contest. *"Eligible survey entries" is defined

The drawings will be conducted on or about April 1, 2005,
by Sponsor-selected judges. The decisions of the judges will
be final and binding in all matters relating to the contest.
By participating, all entrants agree to be bound by the official
rules and decisions of the judges.
Six (6) individual essay winners will be determined by a panel
of judges selected by the Sponsors. Three (3) individual essay
winners will be selected for the middle school essay contest
(ages 11-14), and three (3) individual essay winners will
be selected for the high school contest (ages 15-18). Judges
include employees and officers of the Sponsors. Parents, teachers
and administrators of eligible schools and/or students are
ineligible to judge.
All survey results and essay results will be made available
to all Sponsors. Individual information will not be shared
with Sponsors and will not be published unless parental permission
is obtained. Submitting and entry to this contest gives the
Sponsors the right to publish the essay either in its entirety
or in excerpt and in any format. Writing may be edited. Winning
essays or honorable mentions will be published on the Contest
Web site if a parent consent form is signed. Parent consent
forms are sent electronically or downloaded after the contest
is over and then returned to the MindOH! Foundation by postal
mail or fax at 713-533-9053.
3. WINNER NOTIFICATION: The winners will be notified
by electronic mail, a field required in both the survey and
the essay contests. If a winner cannot be reached during fifteen
(15) days from the Sponsors' first attempt, or if an entrant
is found to be ineligible, an alternative winner may be selected.
4. PARENT AND/OR GUARDIAN CONSENT: For the individual
drawing and the essay contests, the winner's parent or guardian
will be required to sign a consent form in order for any contest
information to be published. Parent consent forms are sent
electronically or downloaded after the contest is over and
then returned to the MindOH! Foundation by postal mail or
fax at 713-533-9053. The student will need to return it within
fifteen (15) days of winner notification. Students and parents
may wish to keep the student's information anonymous, in which
case the student will still receive the prize. If the consent
form is not returned within fifteen (15) days from winner
notification, the prize may be forfeited and awarded to an
alternate winner. Sponsors reserve the right to select alternate
winners.
5. ODDS OF WINNING: The odds of winning are based on
the number of entries received.
6. PRIZES: The grand prize is a new computer with a
one-year license to the MindOH! Discipline and Life Skills
Series for the school with the most individual qualified
participants. The runner-up, the school with the second most
qualified individual participants, will receive the Project
Wisdom Series. The winner of the individual drawing will receive
a Nintendo Gamecube. Additional winners will be drawn for
other prizes donated to the contest.
There will be two essay contests -- one for middle school
students (ages 11-14) and one for high school students (ages
15-18). For each contest, the first place winner of the essay
contest will receive a $500 cashier's check, the second place
winner will receive a $250 cashier's check, and the third
place winner will receive a $175 cashier's check.
Prizes are subject to availability and certain other restrictions.
No returns or exchanges of any prize are permitted. No cash
substitutions, transfers or assignments of any prize is allowed,
except by Sponsors for reason of unavailability, in which
case a prize of equal or greater value will be awarded. Sponsors
are not responsible for any defects, injuries, damages, or
any other liability whatsoever sustained in connection with
the prize. Winner assumes all risk related to the prize, and
acceptance of the prize constitutes waiver of any and all
liability of Sponsors. Sponsors are not responsible for incorrect
or inaccurate entry information, errors contained in the Official
Rules or any technical or human error that may occur in the
processing of the entries in this contest.
7. TO ENTER: Starting January 1, 2005, students may
enter the "Character's Cool Contest" online by following
the instructions found on the website accessed at www.mindohfoundation.org/contest.
Entry limited to one survey and one essay per person. All
entries must be received by 5:00 p.m. (CT) of the last day
of the Contest (January 31, 2005).
Update!
Due to popular demand, we have extended the contest deadline
to February 11th!
Sponsors
are not responsible for any late, lost, delayed, illegible,
or incomplete entries. All entries become the property of
Sponsors and will not be returned.
8. GENERAL CONDITIONS AND DISCLAIMERS: Entrants agree
that the Sponsors shall not be responsible or liable for losses
or injuries of any kind resulting from participating in this
Contest including the acceptance of any prize and/or any technical
malfunctions of the telephone network, computer online system,
computer equipment, software, or any combination thereof including
any injury or damage to entrant's or any other person's computer
related to or resulting from downloading any part of this
Contest and/or promotion. Any person attempting to defraud
or in any way tamper with this Contest will be ineligible
for prizes and may be prosecuted to the full extent of the
law. The Sponsors reserve the right to discontinue this Contest
at any time and modify the rules of the Contest in any way
and at any time.
9. WINNERS and PUBLICITY: The winning schools and individuals
may be posted on the Sponsors' websites. All individual winners
will be asked to sign a parent consent form and a publicity/liability
release. This release allows the sponsors to promote the winners
via press releases, winner profiles and other publicity vehicles.
10. OPT-IN PARTICIPATION: The Sponsors request information
from participants in order to empower youth to practice ethical
behavior and reduce incidents of school violence. It is the
Sponsors' policy to use the information it obtains in an appropriate
and responsible manner. All participants will have the explicit
option to receive information concerning new products, events,
promotions, sales or other marketing activities. If a participant
selects to receive additional information from the Sponsors,
their name and email address will be provided to the Sponsor
companies. And child, teacher, school, school administrator,
parent or caregiver can decline to participate at any time.
It is up to the schools discretion to inform parents
and caregivers about contest participation in advance.
The Sponsors will not sell, or otherwise make available, individual
information concerning contest participants to any other company,
organization or individual. Schools and participating organizations
are not liable for any individual contest participants.
11. THIS CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED
BY LAW.
